Terms of Use

The terms that apply to you and to us when you use the Timyada platform.

Last updated: 10 September 2026

1. Parties and scope

These Terms of Use govern the use of the Timyada business process management platform operated by Timya Bilişim ve Yazılım Hizmetleri ("Timyada", "we"). Any individual or legal entity that creates an account, sets up a site or otherwise uses the service ("Customer", "you") is deemed to accept these terms. Where a separate framework agreement has been signed, its provisions prevail in case of conflict.

2. What the service is

Timyada is a cloud based business process management platform consisting of form design, a BPMN 2.0 process engine, task and document management, electronic signature and reporting. Every customer site runs on its own subdomain and in its own database, isolated from other customers. We improve the service continuously; changes that materially reduce existing functionality are announced in advance.

3. Account and security

You are responsible for keeping your own credentials and those of the users on your site confidential. Passwords are stored only as irreversible hashes; no employee of ours can read your password. If you suspect unauthorised access you must change your password immediately and notify us. We recommend keeping two factor authentication enabled for administrator accounts.

4. Subscription, fees and invoicing

The service is sold as a monthly or yearly subscription per site. Fees are invoiced at the start of each period using the plan price published in the portal. The plan name and amount are written into the invoice at the moment it is issued; later price changes do not affect issued invoices. The due date is the invoice date plus the number of days stated in the portal. If a subscription remains unpaid, access to the site may be suspended after a reasonable reminder period.

5. Acceptable use

When using the service you agree not to:

  • process content that violates applicable law, the rights of third parties or public morals;
  • attempt unauthorised access to the platform infrastructure, to other customers' data or to security mechanisms;
  • use the service to distribute malware, send unsolicited bulk email or consume system resources in an abnormal way;
  • reverse engineer the platform, derive its source code or resell the service (except where a written partner agreement is in place).

6. Customer data and ownership

The data you enter into your site, the forms you design and the process maps you build belong to you. We process them only to provide and support the service and to meet our legal obligations. The platform software, source code, design and trademarks belong to Timya Bilişim; a subscription grants you a non exclusive, non transferable right of use.

7. Availability and maintenance

We make reasonable efforts to keep the service available, but interruptions can occur during planned maintenance, infrastructure provider failures and force majeure events. Planned maintenance is scheduled for low traffic hours wherever possible and announced in advance. We back up your data regularly; even so, we recommend that you export and keep your own copy of critical data.

8. Limitation of liability

To the extent permitted by applicable law, the service is provided "as is". We are not liable for indirect damages, loss of profit or loss of data. In any event our total liability is limited to the subscription fees you paid us for the relevant site during the twelve months preceding the claim. This limitation does not apply to liability arising from our wilful misconduct or gross negligence.

9. Termination

You may end your subscription at any time from the portal; the service continues until the end of the period already paid for. We may suspend or terminate your account in case of a material breach of these terms. After termination your site is closed to access and your data is deleted at the end of the retention period stated in the portal; you may request an export during that period.

10. Changes and governing law

We may update these terms and will announce material changes in the portal before they take effect. Continuing to use the service after a change means you accept the updated terms. These terms are governed by the laws of the Republic of Türkiye, and the courts and execution offices of the Republic of Türkiye have jurisdiction over any dispute.
